George D. Psoinos was born in Asheville, N.C., and attended undergraduate school at North Carolina State University in Raleigh, N.C. He earned his Juris Doctorate Degree in May, 1981 from Northeastern University School of Law in Boston, Massachusetts.

Pre-Suit Mediation - Try It, You’ll Like It”.

Anyone who has been involved in a Lawsuit knows that the Courts require the parties go to Mediation before going to Trial. In the vast majority of cases, the Mediation itself usually takes place within a couple of weeks of the actual Trial date, at a time when the parties have endured many months of aggravation, expense, and disruption to their lives. Wouldn’t it be great if you could get the benefits of Mediation without first having to go through the pre-trial torment of a lawsuit? You can. It’s called Pre-Suit Mediation, and I have used it successfully in many tough cases.

A case in point is one that started back in May of 1995 as a bitterly disputed Guardianship matter, which threatened to escalate into an even more hotly contested Will fight after the gentlemen’s death. The attorneys for the parties began gearing-up for the Will contest. For the next three and one-half months, the attorneys and clients attempted to resolve the matter amongst themselves, but couldn’t do it. Just as settlement seemed impossible, the attorneys suggested trying Pre-Suit Mediation as a last resort. To make a long story short, after 8 1/2 hours of Mediation with a very competent Mediator, the case settled and the Parties walked-away with a nice chunk of change. There is no question that the Clients saved thousands of dollars in attorney’s fees and a couple of years of litigation-hell.

Although Pre-Suit Mediation is not always successful, given the alternative, it’s worth the time and effort. In fact, unless you want one, you do not have to be represented by an attorney. However, all parties who have authority to settle the matter must be present. This is because if there is a settlement, the main terms of it are written down and signed by the parties. Afterwards, either side can have their attorney prepare a more formal Agreement.

I knew that Pre-Suit Mediation was a good idea when our friend, Bubba “Frontier Justice” Jones, said he might give it a try if that little problem at Bertha’s Diner in Bunnell ever escalates. You might want to give it a try, too.
